The Board of Internal Economy, Speaker Peter Milliken, Mark Holland, and the stolen boxes

Mark Holland is trying to cook up a scandal to embroil Public Safety Minister Stockwell Day, and he's using confidential papers he found in boxes that, for some reason, were not delivered to the Prime Minister's Office, even though it appears that they were properly labelled to be moved.

As a side show, the Liberal Party is also trying to make this into an example of how the Conservative Party failed in its responsibility to move these boxes, leaving them to be found by a nosey backbench opposition MP.

The Liberals know better. They know full well that managing office moves falls under the responsibility of the Speaker of the House, through the function of the Board of Internal Economy. This all-party Board exercises remarkably broad powers when it comes to the smooth administrative functioning of Parliament. When confidential material under the Board's care falls into the wrong hands, and worse yet, is made public, the Board has failed dramatically, and ought to be making waves of its own to find out just what happened.

Related: Not everyone faced with having confidential information inadvertently in their possession takes it as a signal to start publishing it far and wide.

From the Parliament of Canada Act, Division D, Board of Internal Economy, Functions:

52.3 The Board shall act on all financial and administrative matters respecting

(a) the House of Commons, its premises, its services and its staff; and

(b) the members of the House of Commons.

This includes offices, and it includes moving material from one office to another.

It is not the responsibility of the party or of the government, but of the House of Commons, assuming office material is properly labeled, to make sure that the material goes to where it is supposed to go.

Despite the pedestrian name, the Board of Internal Economy is one of the most powerful committees in the House of Commons. It is the only committee that sits through prorogation and dissolution. The person in charge of the Board is the Speaker of the House, in this case, Liberal MP Peter Milliken.

Two cabinet ministers sit on the board -- Carol Skelton and Robert Nicholson. The Leader of the Opposition is given a seat too, but in practise that seat is delegated. Right now, Lucienne Robillard represents Liberal Leader Stephane Dion.

The composition of remaining MPs who sit on the board is tipped in the balance of the opposition. There are two Conservative representatives (Jay Hill and Joe Preston), three MPs from the opposition parties (Karen Redman for the Liberal Party, Michel Guimind for the Bloc Quebecois, and Libby Davies for the New Democratic Party).

So if boxes containing old memos were not moved to the Prime Minister's Office as indicated by the labels, the Board of Internal Economy needs to answer for it, because it is their job to keep the administrative functions of Parliament running smoothly on behalf of all parties. That Liberal MP Mark Holland might have had these boxes in his possession for a year, or if that wasn't the case, that he did not turn over these boxes to the Speaker upon discovering them or upon being told of them, should be a matter of concern for the Board. He has undermined their authority and has exacerbated an already serious failure of the Board to fulfill its function.

It will be interesting to see if the Speaker calls Mark Holland out on this. He can according to Section 52.6 (1):

52.6 (1) The Board has the exclusive authority to determine whether any previous, current or proposed use by a member of the House of Commons of any funds, goods, services or premises made available to that member for the carrying out of parliamentary functions is or was proper, given the discharge of the parliamentary functions of members of the House of Commons, including whether any such use is or was proper having regard to the intent and purpose of the by-laws made under subsection 52.5(1).

Interestingly, the only MP who can ask the Board if Mark Holland committed an offence against the Parliament of Canada Act is Mark Holland:

(2) Any member of the House of Commons may apply to the Board for an opinion with respect to any use by that member of funds, goods, services or premises referred to in subsection (1).

I suppose someone could ask the RCMP to look into this, but even then, the Board of Internal Economy has the final say if the investigation is even valid:

52.7 (1) During any investigation by a peace officer in relation to the use by a member of the House of Commons of funds, goods, services or premises referred to in subsection 52.6(1), the peace officer may apply to the Board for, or the Board may, on its own initiative, provide the peace officer with, an opinion concerning the propriety of such use.

In fact, the Board of Internal Economy can squash any investigative process aimed at a member of parliament inasmuch as it applies to how an MP is using the resources of Parliament.

That Mark Holland is making political hay with material that, at best, was overlooked by the Board, or at worst, was kept hidden from the Board to keep it from fulfilling its duties might seem like an esoteric point. But I'd like to think that Speaker Milliken takes it seriously and that he is considering exercising his power under 52.6(1) of the Parliament of Canada Act to make it clear to everyone what responsibility a member of parliament has when he finds parliamentary material that clearly does not belong to him.

1 Again, what are the Conservatives waiting on? Why don't they demand answers at the very least and take some action against Nancy Drew Holland and his sidekick Jennings? Surely MP's have more scruples than to snoop dog other's property, if not they should resign. This is rather serious activity and surely Milliken is aware of that. If he doesn't make an issue of Holland on this escapade, he's not doing his job.

2 Unfortunately, Mr. Milliken is a staunch liberal to his bones and has given indications in the house to this end. Don't expect him to acknowledge his complicity in this totally unethical theft of private Conservative memorandas & notes. Totally expected behaviour from Holland & Jennings, though; they couldn't muster an ounce of integrity or ethics between the 2 of them to weigh down a fruit fly.

3 It would seem Mr. Holland is devoid of ethics or integrety. I heard on Duffy that it is compared to Grewal which I do not accept as even in the same league. To even be close to similar the conservatives would have had to invite Holland to join the CPC and as an inducement offered to let him read the contents of the boxes. I think that criminal onsequences might yet haunt the Libs who have clearly overstepped their mandate.

10 My memory on this is vague, but I seem to remember seeing a biography, or perhaps an interview on TV with Mike Duffy, which told the story of Duffy somehow accidentally receiving some high profile, confidential governement documents, but promptly forwarding them to the proper addressee, unopened. These documents could have been a good scoop for a journalist, but he still did the right thing and returned them unopened. Does anyone else recall this? I cannot find any written reference to this incident - I just vaguely recall seeing the story told on TV. If true, it would be a good story to read to Mr. Holland.

11 Considering all the "dirty" tricks the Conservatives under Harper played two and three years ago, they have a nerve complaining. Right or wrong - something smells here and I'd rather find out the truth that worry about the boxes and their delivery. Stockwell Day has a little history - like deliberately delaying a legal action against him so that he could get elected first. I think the Conservatives are truly trying to twist this to be the Liberals fault (their usual pattern) so they won't be found out.

12 Anyone who would defend Holland and/or the Liberal party for this week's actions really does need to get a life (or join a party which has a leader that inspires one to follow, not roll your eyes and shake your head). The Trolls who come out of the bushes like Cherniak bush-babies and leave an odor on an otherwise outstanding Blog should stick to cross-breeding with the NDP and Greens. This would account for the peculiar voting patterns in Toronto/Montreal/Vancouver.

Dear Speaker Milliken, I understand that it is your offices responsibility to ensure that the confidential contents of offices that are relocated reach their destination in a timely and “unopened” manner. Perhaps you have seen the despicable parading of confidential documents in public, in various media by MP’s Mark Holland and Marlene Jennings. It is my understanding that these documents have been missing for close to a year and just now have turned up opened and confidential material paraded on TV. It seems to me that such conduct by these two MP’s is highly unethical if not downright criminal! Is it not your responsibility to ensure these documents get to their destination in a timely manner? If these documents where in the hands of these or other MP’s and riffled through, I think you should be outraged and want to find out what happened and why and make a full public accounting of your findings. To not do so would bring disrepute to your high office and serve to tell me that another Liberal cover up is in the works. As the Speaker of the House you are supposed to be above partisan politicking and should be more upset than anyone else over this obvious wrongdoing.
